Direct Filing
Any plaintiff whose case would be subject to transfer to the AFFF MDL proceedings may file his or her case directly in the District of South Carolina, in accordance with Paragraphs 25 through 29 of CMO 3.

IMPORTANT REMINDERS:
- New counsel must be registered for electronic filing for the District of South Carolina. (See FAQ How do I register?)
- Pursuant to Text Order at ECF 134 issued by the Court, for all cases in the MDL proceedings, the parties are relieved from complying with the requirement of Local Civil Rule 26.01, DSC.
- Civil cover sheets need not be filed for cases directly filed in the AFFF MDL.
- Per CLERK'S NOTICE(s) at ECF 135, 378, 455, 1131, 2076, counsel need only submit one proposed summons document AO 440 form, as an attachment to the new complaint, for a summons to be issued by the Clerk's office. Please provide the first listed defendant party's name and address on the form and attach additional pages as needed, which include the additional defendants' names and addresses, to the one AO 440 form (PDF). Per CLERK'S NOTICE(s) at ECF 455, 1131, 2076, please note CMO 6(s) provide an alternative for service of process on a defendant via email address.
- Per CLERK'S NOTICE(s) at ECF 1908 and 3268, be sure to prepare the new complaint (or notice of removal document), to list the defendants in alphabetical order, one defendant party per separate line(s) separated by appropriate punctuation (semicolon preferred), in the caption.
