Request For Public Comment for Amended Local Civil Rules

Pursuant to Title 28 U.S.C. ยง 2071(e) and Rule 83 of the Federal Rules of Civil Procedure, the United States District Court for the District of South Carolina invites public comment on the following amended Local Civil Rules:

  • 83.I.04: Representation by Local Counsel Who Must Sign All Pleadings. (revised)
  • 83.I.06: Pleadings, Service, and Attendance by Local Counsel in Cases Where Out-of-State Attorneys                     Appear. (revised)
  • 83.VII.02: Initial Service of Process. (new)
  • 83.VII.03: Reference to Magistrate Judge. (revised to re-number)
  • 83.VII.04: Answer of the Commissioner. (revised and re-numbered)
  • 83.VII.05: Expediting Cases. (new)
  • 83.VII.06: Petitioner's Brief. (revised and re-numbered)
  • 83.VII.07: Commissioner's Brief. (revised and re-numbered)
  • 83.VII.08: Service of Briefs. (revised to re-number)
  • 83.VII.09: Objections to Report and Recommendations. (revised and re-numbered)
  • 83.VII.10: Application for Attorneys' Fees. (revised to re-number)



  • The public comment period is now open. The Court will consider all public comments submitted via email to Local_Rules_Public_Comments@scd.uscourts.gov.

    Any modification to the local rules necessary as a result of public comments will be considered after April 11, 2022, the expiration date for receiving said comments.
